SUPREME COURT STRIKES OUT SUIT AGAINST PROF AVOKE’S REINSTATEMENT

The Supreme Court has struck out a suit challenging the reestablishment of Professor Mawutor Avoke as the Bad habit-Chancellor of the College of Instruction, Winneba (UEW).

 

 

The Incomparable Court struck out the case on Tuesday (March 1, 2022), reports Realistic Online.

 

The plaintiff, Emmanuel Ansong Baah, a inhabitant of Darkuman in Accra, who sued in his capacity as a Ghanaian, recorded a take note to cease the case, which was allowed by the court.

 

Baah was inquiring the Incomparable Court to quash the choice of the Winneba Tall Court requesting the UEW to reinstate Prof Avoke.

 

 

Grounds

 

It was the case of the candidate that the case driving to Prof Avoke’s reestablishment was not appropriately recorded and so the Winneba Tall Court has no ward to decide it.

 

The candidate contended that the case was filled out of time since it was recorded four a long time after the said occasions driving to the sacking of Prof Avoke.

 

 

“That I have been exhorted and accept same to be genuine that since the application was recorded out of time, the respondent (Winneba Tall Court) should not to have engaged it since it was opposite to the rules,” the candidate said.

 

Once more, the candidate is of the dispute that a report by the Economic and Organised Crime Office (EOCO) which excused Prof Avoke of any wrongdoing was not legitimately some time recently the Winneba High Court, and so the court committed an mistake when it depended on it for the judgment.

 

“For a archive radiating from an office of the state to be a legitimate report, at slightest it should to have been marked, stamped and likely on the Letter Head of that institution but within the moment case, it was not the case,” the candidate fought.

 

Based on the over reasons, the candidate encouraged the Supreme Court to quash the choice of the Winneba High Court.

 

“The respondent (Winneba Tall Court) depending on the EOCO report to arrange the 2nd interested party (UEW) to reinstate the rejected officers was wrong and must not be permitted to stand by the summit court of the arrive,” the candidate contended.
