The Court of Appeal's choice in Ex parte Hoda Holdings Ltd

 

Hoda Holdings Ltd was not happy with the High Court's choice so it documented an allure against the choice at the Court of Appeal.

 

The grounds of allure: Hoda Holdings Ltd pursued against the High Court's choice on three grounds. The main ground of allure was that, the High Court was off-base in deciding that Bank of Ghana had the ability to deny Unicredit's permit under Section 123 of Act 930 rather than Section 16 of the Act, and neglecting to give the organization a conference. Furthermore, the High Court was off-base in saying that, Unicredit was undercapitalized when no proof to such impact was put under the watchful eye of the court. The third ground of allure recorded by Hoda Holdings Ltd was that, the High Court was off-base in expressing that Bank of Ghana was at freedom to force any discipline, including a denial of permit of a bank or concentrated Deposit Taking Institution which was undercapitalized, without first impressive the legal punishment under Section 33 of Act 930. The Court of Appeal noticed that the last two grounds connected with meaningful issues and appropriately declined to address them.

 

The Court of Appeal's choice and the purposes behind it: The Court of Appeal held that, the High Court's choice in declining to give a request for certiorari to subdue Bank of Ghana's denial of Unicredit's permit was off-base. The Court of Appeal put away the High Court's choice and expressed that, Bank of Ghana was off-base in renouncing Unicredit's permit without following the method spread out in the law, that is to say, Act 930. The Court of allure requested that the notification gave by Bank of Ghana and dated sixteenth August, 2019 repudiating Unicredit's permit be as needs be suppressed.
