THE PROSECUTION CONTESTS THE ACCUSATION MADE BY THE ACCUSED THAT I SOUGHT TO SAVE MAJOR MAHAMA.

A year ago



One of the 14 people charged with the murder of Major Maxwell Adam Mahama claimed that he attempted to save the military commander from an alleged lynching instead.



Charles Kwaning testified before the Accra High Court on Monday [April 3, 2023] that he attempted to stop others from attacking the soldier with stones and cement blocks and stopped someone from shooting Major Mahama.



Kwaning was told by the prosecutor, Ms. Frances Mullen Ansah, a Chief State Attorney, that he pointed a revolver at the military commander and was a key player in the death by using images from the film displaying the lynching.


By citing purported discrepancies between the accused's evidence before the court and the statements he made to the police after being detained, the prosecution further suggested to the defendant that he was not being truthful to the court.


Supposed lynching


On May 29, 2017, Major Mahama was fatally wounded in Denkyira Obuasi in the Central Region.


He was allegedly lynched while out on a morning stroll that took him through the neighborhood.


In relation to the killing of the military commander, 14 people are now on trial, including William Baah, the local assemblyman at the time.



On charges including murder, aiding the commission of murder, and conspiracy to commit murder, they have all entered pleas of not guilty.


Testimony


The 11th accused individual, Kwaning, opened his defense by informing the court that at the time of Major Mahama's lynching, he was a vulcanizer working and living in Denkyira Obuasi.


He said that on May 29, 2017, not long after arriving at his store at around 8 a.m., he observed Baah (Assembly Man) and another guy riding a motorcycle at full speed.



He said Baah told him he was at the school instructing students when two ladies called to warn him that a man with a gun was approaching the town.


He claimed that after joining the group of men, they soon caught up with Major Mahama, who was moving quickly.


Kwaning allegedly stated that Major Mahama brandished a pistol at them, causing him to flee.


Afterwards, he claimed, two individuals—Yaw Amankwah and another—arrived at the scene brandishing firearms, calling Major Mahama a thief, and exchanging gunfire with the military officer.
