In recent years, there has been a concerning trend of African countries passing anti- LGBT bills. Among the African countries that have implemented such legislation, Ghana stands as one of the prominent examples. However, it is essential to note that there are 5 other African countries that have also passed similar laws, exacerbating the challenges faced by the LGBT community.
NIGERIA
Nigeria, the most populous country in Africa, passed the Same- Sex Marriage (Prohibition) Act in 2014.
This law criminalizes same- sex marriage, same- sex relationships, and membership in LGBT organizations, with severe punishments including imprisonment of up to 14 years. This legislation has led to increased discrimination, harassment, and violence against LGBT individuals in the country.
UGANDA
Uganda gained international attention in 2014 when it passed the Anti- Homosexuality Act, which imposed life imprisonment for certain homosexual acts and criminalized the " promotion" of homosexuality. Although the law was later invalidated by the country' s Constitutional Court due to procedural issues, it had a chilling effect on the LGBT community and led to an increase in stigma and persecution.
TANZANIA
In 2019, Tanzania implemented the Electronic and Postal Communications (Online Content) Regulations, which specifically targeted LGBT individuals and their rights. The law empowered authorities to censor and punish online content related to homos£xuality, leading to self- censorship among the LGBT community and further marginalization.
GAMBIA
The Gambia passed the Criminal Code (Amendment) Act in 2014, criminalizing " aggravated homosexuality" and imposing lengthy prison sentences for same- sex sexual acts. The law also includes provisionsthat restrict the activities of organizations advocating for LGBT rights, further isolating and endangering the community.
BURUNDI
In 2009, Burundi enacted a law criminalizing consensual same- sex sexual activity. The legislation imposes prison terms ranging from three months to two years for engaging in same- sex relationships. This law has perpetuated discrimination and stigmatization against LGBT individuals in the country, impeding their ability to live openly and freely.
