In a statement released on social media, Samuel Okudzeto Ablakwa announced that the Human Rights Court has dismissed the application brought by Reverend Victor Kusi Boateng/Kwabena Adu Gyamfi, stating that the court's judgement was emphatic in its findings.

Ablakwa revealed that the court had ruled that his parliamentary oversight had uncovered two distinct identities being used by Boateng/Gyamfi in a manner that bordered on criminality, and that the application was dismissed for lack of capacity and locus standi.

The court also awarded costs of GHS10,000.00 against Boateng/Gyamfi, marking the second time that costs have been awarded against them. Ablakwa thanked his outstanding legal team and dedicated the legal victory to the masses who have kept him resolute with their prayers and support for transparent and accountable governance.

According to Ablakwa's statement, the court's ruling confirmed that Kwabena Adu Gyamfi and Victor Kusi Boateng were two separate identities being used concurrently by the applicant.

The court found that the way in which the two identities were used suggested a pattern of duplicity designed to conceal the applicant's dealings in a manner that was not immediately obvious, until Ablakwa's investigations and publications brought them to light.

The application sought to be enforced under Article 33(1) of the 1992 Constitution, which requires that an applicant have a personal interest in the matter to confer locus standi. However, given the clear case of double identity presented and proven before the court, it was ruled that the application was dismissed for lack of capacity and locus standi.

In light of the ruling, costs of GHC10,000 were awarded against the applicant in favor of Samuel Okudzeto Ablakwa. This is the latest setback for Boateng/Gyamfi, who still have one more legal battle to fight in their defamation suit.

Overall, the court's ruling serves as a reminder of the importance of transparency and honesty in dealings, particularly in cases where public figures are involved in projects that impact the wider society.

It highlights the need for those in positions of power and influence to be held to a higher standard of accountability and transparency, and that any attempts to conceal dealings in a manner that borders on criminality will not be tolerated.
