The request that Gyakye Quayson submitted to the Court of Appeal asking for a stay of proceedings in his trial before the High Court was denied.
Following the dismissal of his lawsuit by the High Court, the Member of Parliament submitted the application to the Court of Appeal last week.
His bid to have the proceedings halted so that the Court of Appeal may hear his appeal against the decision of the trial judge to hear his case on a daily basis was turned down by the High Court, despite the fact that he had asked the High Court to do so.
After that, he took the matter to the Court of Appeal, where he lost his appeal, which was eventually overturned.
The Member of Parliament is being tried in the High Court in Accra on allegations of forgery and perjury.
The appeal that was submitted by the Member of Parliament for Assin-North, James Gyakye Quayson, to have his perjury and forgery trial put on hold until the Court of Appeal decides on a challenge against the trial court was recently rejected by the Accra High Court. The application was brought before the court by Quayson.
The judge presiding over the case, Mary Maame Ekue Yanzuh, came to the conclusion that the petitioner had not adequately demonstrated the existence of exceptional circumstances that would justify the granting of a stay of proceedings.
"I am unable to agree with the submission that the appeal has a brighter chance of success because of errors of law. I have looked into this, and I have found no errors."
The judge who is presiding over the case stated a week ago that the fact that the applicant believes his appeal would be successful does not in and of itself merit a particular circumstance that would allow a stay to be granted.
