A few of them are highlighted below;

There's no debate here. If the builder has delivered subpar work then he doesn't get the second half of his pay until he has fixed the issues. The guy said he has a toilet that doesn't work. If you took your car in to get an oil change and a service, but the garage damaged the engine to the point the car now won't start, they wouldn't say pay the service bill then we will fix the damage we have caused.

The builder is in the right 100% The client has no right to withhold funds after signing it off. If there are problems arising from the workmanship then that is a separate warranty issue and the client still has no right to withhold funds. It is up to the client to claim a warranty against the builder and the builder is obligated to remedy the issues under warranty.

Again it has absolutely nothing to do with the balance of the contract value owed to the builder, it must be paid. The client has taken the law into his own hands and effectively caused a stalemate, further to that he has threatened the builder with reputation damage all the while withholding funds illegally. The builder is in the right 100%, the client is in the wrong 100%.

@alialtafsaleem

He signed off on the work so he should have paid the full amount. If any warranties etc. were made, that is not clear at the moment. So far it seems like the contractor was not responsible for issues arising after the work had been accepted as satisfactory.

@Hellyale

Builder not even going to go in and see what is wrong?

The customer is looking like they have firm standing.

Pretty sure the builder's solicitor is going to advise him to fix the problems, and then collect the money.

1 paid $10k to have a patio done by someone who seemed very professional and had great reviews.

After he finished the job, it looked great and so I paid him the other half he was due. 1 week later, the entire thing collapsed and it was due to a cheap base that was also used improperly. On top of that, they hit our irrigation line multiple times and so there were major leaks we couldn't see until we got a $700 water bill. The guy disappeared and won't answer calls or respond to complaints. The point is, sometimes you can't identify shotty work when the job is complete. I wish I did what this guy did and waited 2 weeks to pay the contractor. No doubt this man has been burned before.

@RObG413

The builder is right. The customer didn't have a problem with the job until 2 weeks after the job was finished. By then the 5 grand should've already been paid. And if there was a problem 2 weeks later I'm sure the builder wouldn't mind coming back to fix it.
