The media company says that the NMC did something wrong by not letting them speak up before giving punishments. They believe this goes against the law and fairness.
In a letter from November 14, 2023, the NMC told Onua TV/Onua FM and Captain Smart that they needed to say sorry for something said on the air that was seen as stirring up trouble.
But Onua TV/Onua FM is not saying sorry. Instead, they're taking the NMC to court, claiming that the NMC is unfairly bothering them for political reasons. They say the NMC is acting like a complainer, a lawyer, and a judge all at once, which isn't fair.
The disagreement started because Captain Smart supposedly said bad things about the Chief of the Defence Staff (CDS) and other leaders of the Ghana Armed Forces in a recent broadcast. He called them "beasts" and accused them of stealing money meant for soldiers on peacekeeping missions. But he didn't show any proof for these claims.
The NMC told Onua TV/Onua FM and Captain Smart to take back what they said, apologize to the CDS and others, say sorry to the people of Ghana for using bad language, and do things to follow the rules better by November 19, 2023.
But in a letter dated November 21, 2023, Onua TV/Onua FM didn't seem to do what the NMC asked them to do.
The NMC, therefore, gave Onua TV/FM and Captain Smart until November 19, 2023, to withdraw the insults and apologize to the CDS and his commanders; apologize to the Ghanaian public for the use of vulgar language, and put in measures to stop the dangerous behavior of the station and improve the station’s capacity for regulatory compliance.
