Empty Chair: Speaker's lawyers absent as Supreme Court defers ruling.
The Supreme Court has deferred its ruling on the four vacant parliamentary seats.
The case which is seeking to prevent the removal of the four MPs because of their decision to cross carpets in the upcoming December 7 election, was adjourned on October 30.
Chief Justice Gertrude Torkornoo had at the last sitting, directed the Speaker of Parliament, Alban Bagbin to file the relevant documents by Wednesday, November 6.
That was after an application by lawyers of the Speaker, Thaddeus Sory, praying for time to consult the Speaker and seek the necessary instructions.
However, at the Monday, November 11 sitting, lawyers for Speaker Bagbin failed to file any legal documents let alone make an appearance.
The seven-member panel, presided over by Chief Justice Gertrude Sackey Torkornoo, decided to hear the case because the plaintiff, Alexander Afenyo-Markin, and the Attorney-General-the second defendant-had both filed their processes.
The date was announced by the Chief Justice, Gertrude Torkornoo, after listening to the two sides, indicating that the Apex Court was ready to bring clarity to the situation. The case is expected to be heard by the Apex Court and a ruling given on Tuesday, November 12.
The Attorney-General showed strong disapproval of the action of the legal team of the Speaker and took a serious view of the absence of Thaddeus Sory. The argument of the Attorney-General was that Mr. Sory failed to appear in court or file the necessary documents and, hence, he failed to show respect for the judicial process.
