The Sekondi High Court has lifted an interlocutory injunction against Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, allowing her to contest in the December 2024 elections. This ruling, delivered on November 11, 2024, by Justice Gyan-Kontoh, removes a significant legal hurdle that had cast uncertainty on Cudjoe’s candidacy.
The injunction stemmed from allegations that Cudjoe submitted falsified documents to qualify for the NDC’s primary election. Following these allegations, the Electoral Commission initially disqualified her. In response, the NDC took steps to nullify its initial primaries and held a new election, in which Cudjoe emerged as the preferred candidate after the incumbent MP, Peter Kwakye-Ackah, withdrew from the race.
Cudjoe’s legal team, led by her new attorneys, argued that the injunction was unfairly hindering her right to represent her constituency. They urged the court to dismiss it, emphasizing the importance of preserving her candidacy for the December parliamentary elections. Justice Gyan-Kontoh agreed, ultimately vacating the injunction and restoring her eligibility to stand for election.
In a statement shared on social media shortly after the ruling, Cudjoe expressed her gratitude and relief, calling it a “victory for Amenfi Central.” She noted the critical role her new legal team played in achieving this outcome and shared her appreciation for their efforts. Reflecting on the challenges of the past weeks, she remarked, “I’m overjoyed and grateful to God for this positive turn of events. It’s a reminder that those you trust most can sometimes harm you.”
Addressing the media after the ruling, she extended her thanks to her supporters, constituents, and the NDC, particularly those in Amenfi Central, for standing by her throughout the legal proceedings. She announced plans to shift her focus to launching her campaign and advancing her electoral preparations, declaring that she was “ready to move forward” with full support from her party and constituents.
The case highlights some of the hurdles that candidates may face within Ghana’s electoral process. Allegations and legal challenges can create delays, yet timely judicial decisions play a pivotal role in ensuring candidates have the opportunity to participate fully in the democratic process. The court’s ruling in favor of Cudjoe ensures that voters in Amenfi Central will have access to a broader slate of candidates in the upcoming election.
This decision, welcomed by her supporters, reflects the judiciary’s role in upholding electoral fairness and accessibility. Cudjoe’s reinstatement as the NDC candidate not only solidifies her political standing but also underscores her resilience in overcoming obstacles to represent her community.
