The ECOWAS Court of Justice has ruled in favor of Shalimar Abbiusi, the spokesperson for the New Force, in a case against the Republic of Ghana. The court determined that Ghana violated Ms. Abbiusi’s fundamental rights through wrongful arrest, rearrest, and deportation in December 2023. The ruling underscores the importance of accountability and adherence to human rights in democratic governance.
Ms. Abbiusi’s ordeal began with her initial arrest by the Ghana Immigration Service (GIS) under allegations that were later dismissed by the State Prosecutor. Despite the dropped charges, she was rearrested and subsequently deported, actions deemed unlawful by the ECOWAS Court. The court found these measures to be in violation of Article 6 of the African Charter on Human and Peoples' Rights, which protects individual liberty.
The judgment declared that Ghana’s actions caused significant harm to Ms. Abbiusi’s personal and professional reputation. The court ordered the Ghanaian government to compensate her, marking a pivotal moment in the fight for justice and human rights within the region.
Francis-Xavier Sosu, Esq., who represented Ms. Abbiusi alongside lawyer Belinda Narkey Quaynor, expressed gratitude for the ruling. “We feel vindicated that the ECOWAS Court has protected the rights of Shalimar,” Mr. Sosu stated, highlighting the significance of the decision in safeguarding democratic principles.
The New Force, an organization advocating for fairness and justice across Africa, welcomed the ruling as a victory for human rights. “This case exemplifies the dangers of political persecution, which threaten the foundations of democracy. We urge the Ghanaian government to uphold the rule of law and respect constitutional guarantees,” the group stated.
The ruling has sparked a call to action for governments, civil society organizations, and international bodies to condemn similar violations and promote institutional reforms. The New Force encouraged collaboration to strengthen human rights protections and prevent future abuses.
This case highlights the ECOWAS Court’s role as a critical platform for addressing grievances against member states and enforcing adherence to regional legal standards. It also underscores the need for vigilance in protecting individuals’ rights, especially those in politically sensitive roles.
As Ghana prepares to implement the court’s ruling, the decision serves as a reminder of the importance of upholding international human rights obligations. It also emphasizes the power of legal advocacy in securing justice for individuals wrongfully targeted by state actions.
