NDC Accuses High Court Judge of Bias in Re-Collation Order

The National Democratic Congress (NDC) has raised serious concerns about what it calls bias and partiality exhibited by a High Court judge in a recent ruling ordering a re-collation of votes in a disputed constituency election.

The controversy stems from the ongoing legal battle over the parliamentary results of the Techiman South Constituency, which has been a point of contention since the 2020 general elections. The court's directive, issued on December 27, 2024, ordered the Electoral Commission (EC) to conduct a re-collation of votes within 14 days to resolve the dispute. However, the NDC claims the judge's decision is tilted in favor of the ruling New Patriotic Party (NPP).

Speaking at a press briefing shortly after the court ruling, NDC General Secretary, Fifi Kwetey, expressed the party's dissatisfaction. "We are deeply concerned about the conduct of the judge in this matter. His posture, comments, and ultimate ruling suggest a predetermined agenda to favor one party," he alleged.

Mr. Kwetey further accused the judge of ignoring critical evidence presented by the NDC's legal team, which he said should have warranted a different ruling. "Our lawyers presented irrefutable evidence of irregularities in the original collation process, but these were either overlooked or dismissed without justification," he added.

The NDC also argued that the re-collation order fails to address fundamental issues, such as alleged discrepancies in the polling station results and the lack of transparency in the collation process. The party insists that a re-collation without first resolving these concerns would only perpetuate injustice.

In response, the NPP has dismissed the NDC's claims, describing them as baseless and an attempt to discredit the judiciary. NPP Communications Director, Richard Ahiagbah, stated, "The court acted within its mandate and issued a fair ruling based on the evidence before it. The NDC should respect the rule of law."

The development has sparked widespread debate among Ghanaians, with many questioning the impartiality of the judiciary in politically sensitive cases. Civil society groups and political analysts have called for calm while urging the NDC to pursue its grievances through appropriate legal channels.

The NDC has vowed to appeal the ruling at the Court of Appeal, seeking a reversal of the re-collation order. Meanwhile, the EC has indicated its readiness to comply with the court's directive.
