Afenyo-Markin Dismisses NDC’s Objection, Says EC Is Resolving Disputed Results


Majority Leader in Parliament, Alexander Afenyo-Markin, has criticized the National Democratic Congress’s (NDC) objection to a mandamus application filed by four New Patriotic Party (NPP) parliamentary candidates. The application seeks to compel the Electoral Commission (EC) to finalize collation and declaration of results in Okaikwei Central, Ablekuma North, Tema Central, and Dome Kwabenya constituencies. Afenyo-Markin emphasized that the EC is already addressing these issues administratively and has acknowledged irregularities in the collation process, which prevented valid declarations in these constituencies. Speaking after the High Court set January 1, 2025, for a ruling on the NDC’s objection, he dismissed their claims that results had already been declared, pointing out that the EC itself admitted no proper declarations had occurred.

The Majority Leader underscored the significance of allowing the legal process to take its course, contrasting the NPP’s reliance on the rule of law with what he described as the NDC's initial approach to the disputed results. He expressed confidence in the judicial system, stating, “At least, we’ve managed to bring them to civility in the courtroom. We believe in the rule of law and are confident in the outcome.” He further argued that the NDC’s objection to the mandamus application is misplaced since the EC had already planned to address the disputed results administratively. The NPP’s application is intended to ensure transparency by legally compelling the EC to complete the process of collation and declaration.

The High Court’s decision on whether to proceed with the mandamus application or uphold the NDC’s objection is expected to set a critical precedent in managing electoral disputes in Ghana. Afenyo-Markin emphasized the importance of resolving these disputes within the framework of the law to maintain the integrity of Ghana's democratic processes. He warned against setting a dangerous precedent that undermines the EC’s role and promotes disputes outside legal boundaries. The ruling is anticipated to reinforce the need for adherence to legal and administrative procedures, ensuring that electoral outcomes are both transparent and credible.
