Dr. Dominic Ayine, Attorney General and Minister of Justice-designate, has pledged to safeguard Ghana’s interests in all international contracts and legal transactions. Speaking during his vetting by Parliament’s Appointments Committee on January 13, 2025, he assured the nation of his unwavering commitment to implementing stringent measures that will shield the public from financial losses and ensure legal accountability in such dealings.
His assurances come at a time when the public has raised concerns about Ghana's exposure to judgment debts and losses in international arbitration cases. Dr. Ayine expressed confidence in his ability to manage these issues, citing his extensive experience in international arbitration as a key strength.
Dr. Ayine emphasized that his priority as Attorney General would be to ensure that Ghana's resources and financial interests are protected in all legal and contractual matters, particularly those involving international arbitration.
“I can assure the house that if they are [legal contracts] before the London Court of International Arbitration, I’m quite familiar with that tribunal. I have appeared before that tribunal several times. I can assure you that I will put in the measures that will ensure that the interest of the public is not compromised,” he stated during the vetting.
He elaborated on his familiarity with international legal frameworks and tribunals, noting that his extensive legal experience positions him to effectively handle any disputes that may arise. Dr. Ayine further underscored the importance of preventing the country from incurring avoidable financial losses, assuring Parliament and the public of his readiness to act in Ghana’s best interest.
One of Dr. Ayine’s key proposals is to strengthen the country’s legal framework governing contracts and arbitration. He intends to prioritize the drafting and implementation of comprehensive policies that will regulate Ghana’s engagement in international agreements.
Dr. Ayine highlighted the need to adopt preventive measures rather than relying solely on damage control after disputes arise. According to him, the introduction of stricter guidelines for contract negotiations and arbitration processes will ensure transparency and reduce the risk of future financial liabilities for the country.
During his vetting, Dr. Ayine took the opportunity to address concerns about judgment debts, a sensitive issue in Ghana’s political and legal discourse. He defended the record of the previous National Democratic Congress (NDC) administration, asserting that there were no questionable incidents of judgment debts during its tenure.
Judgment debts, which arise when courts order the government to compensate individuals or entities for breaches of contract or other obligations, have been a contentious issue in Ghana. Critics have often accused successive administrations of negligence in contract management, leading to significant financial losses.
Dr. Ayine promised to adopt a proactive approach to prevent such occurrences under his leadership. He noted that his administration would prioritize due diligence in contract negotiations and ensure that Ghana enters agreements that are legally sound and financially prudent.
Dr. Ayine’s confidence in managing Ghana’s legal interests stems from his extensive background in international arbitration. He revealed that he has represented clients before major arbitration tribunals, including the London Court of International Arbitration (LCIA).
His familiarity with arbitration procedures and legal complexities, he believes, equips him to effectively represent Ghana in any disputes that may arise. Dr. Ayine also emphasized the importance of building a robust team of legal experts to support his office in navigating international legal challenges.
“International arbitration requires a combination of expertise, strategy, and attention to detail. I have the experience, and I am committed to assembling a team that will work tirelessly to protect Ghana’s interests,” he stated.
Dr. Ayine also addressed the importance of transparency and accountability in government dealings. He pledged to ensure that all international contracts are subject to thorough review and scrutiny before they are signed. This, he said, will minimize the risk of legal disputes and ensure that the country gets the best value from its agreements.
He urged government officials and stakeholders to prioritize the national interest over personal or political considerations when entering contracts. According to him, the government must work collaboratively to safeguard Ghana’s resources and reputation on the international stage.
Dr. Ayine’s assurances have been met with cautious optimism by members of Parliament and the public. While many have expressed confidence in his ability to deliver, others have called for continuous oversight to ensure that his promises are translated into tangible results.
Parliament’s Appointments Committee has lauded his proactive approach and extensive experience, describing him as a suitable candidate for the role of Attorney General. However, they also emphasized the need for him to remain accountable to the public and work closely with other stakeholders to achieve his goals.
Dr. Ayine concluded his vetting by calling for national unity and collaboration in addressing Ghana’s legal and financial challenges. He stressed that safeguarding the country’s interests requires the collective effort of all stakeholders, including the government, Parliament, civil society, and the legal community.
“As Attorney General, my role is to serve the people of Ghana. I will work tirelessly to protect our interests and ensure that justice is upheld in all our dealings. But this is not a task I can achieve alone. I need the support of every Ghanaian to make this vision a reality,” he stated.
As Dr. Ayine prepares to assume office, expectations are high for him to deliver on his promises and restore public confidence in the government’s handling of international contracts and legal disputes. His emphasis on experience, transparency, and accountability has resonated with many, setting the tone for what could be a transformative tenure as Attorney General.
With Ghana facing increasing scrutiny over its financial management and legal commitments, Dr. Ayine’s leadership will undoubtedly be a critical factor in determining the country’s ability to navigate these challenges successfully.
