ANOTHER LEGAL BATTLE AROUND THE CORNER

The recent arrest of Gifty Oware-Mensah by the National Intelligence Bureau (NIB) has sparked a potential legal battle. Renowned private legal practitioner, Martin Kpebu, has vowed to take action if Oware-Mensah is not released or arraigned before a court within 48 hours, as mandated by Ghana's Constitution.

From a legal standpoint, Kpebu's threat is grounded in Ghana's constitutional provisions. Article 14(3) of the 1992 Constitution explicitly states that a person arrested or detained must be brought before a court within 48 hours. Failure to comply with this provision could result in a habeas corpus application, which Kpebu has hinted at filing on Oware-Mensah's behalf.

Politically, this situation has far-reaching consequences. The NIB's actions may be perceived as an attempt to silence Oware-Mensah, who has been implicated in the National Service Scheme (NSS) ghost names scandal. Kpebu's involvement adds another layer of complexity, given his reputation as a vocal critic of government actions.

Kpebu's decision to represent Oware-Mensah is also noteworthy. As a member of John Mahama's Operation Recover All Loot Team, Kpebu's involvement may be seen as a strategic move to counter the government's narrative. This development has the potential to escalate tensions between the ruling party and the opposition.

The NIB's actions will be closely scrutinized in the coming hours. If Oware-Mensah is not released or arraigned within the stipulated timeframe, Kpebu's threatened legal action could set off a chain reaction. This might include a habeas corpus application, followed by a potentially lengthy and contentious court battle.

As the clock ticks down, all eyes are on the NIB and Kpebu. Will the NIB comply with the constitutional provisions, or will Kpebu be forced to take legal action? The outcome of this standoff will have significant implications for Ghana's legal and political landscape.

In conclusion, this looming legal battle serves as a reminder of the importance of upholding constitutional provisions and protecting individual rights. As Ghanaians, we must remain vigilant and demand that our institutions adhere to the rule of law.
