AKUAPEM POLOO HAS PAID A GH12,000 FINE AND IS EXPECTED TO BE RELEASED SOON

Actress Rosemond Alade Brown, better known as Akuapem Poloo, has paid a fine of 1000 penalty units, or GH12,000, in lieu of her 90-day prison sentence. 
The actress, who is currently imprisoned in Nsawam, is expected to be released on December 16, 2021, after paying the fine. 

Murtala Inusah, an EIB Network Court Correspondent who is monitoring events at the Court, reports that the money has been paid to the Judicial Service and that her lawyers, led by Andrew Kudzo Vortia, have received a receipt of payment dated December 16, 2021. 

A prison sentence was overturned. 

On December 15, a three-member panel of the Court of Appeal overturned her 90-day prison sentence. 
After the prosecution told the court that the Republic is not opposed to both the bail application and the substantive appeal, the judge agreed.

The actress's lawyers, led by Andrew Kudzo Vortia, argued that the 90-day prison sentence was excessively harsh and requested that it be replaced with a fine. 

After pleading guilty to three charges, Akuapem Poloo was sentenced to 90 days in prison on April 16. 

Her first appeal to have the decision reversed was dismissed by the High Court on December 1. 
The panel chaired by His Lordship Justice Henry Anthony Kwoffie said in court on Wednesday, December 15, that while the 90-day sentence was appropriate, they are considering replacing it with a fine. 

The court stated, "We have decided to take the substantive appeal regarding the submission filed by the Appellant's learned counsel and the fact that the Republic does not oppose." 

The panel went on to say that it considered the sentencing scale and that "we have taken the view that the sentence was fair."

However, it took into account the seven-year-old son's interests as well as the fact that he will require parental care. 
The jury also took into account the fact that the defendant is a single mother who has expressed remorse since her conviction. 

The court hoped that "she will learn a good lesson of what she has gone through" after describing the incident that led to the custodial sentence as "foolish ways." 

To that end, the court imposed a fine of 1000 penalty units (GH12,000) on count A and 500 penalty units (GH6,000) on counts 2 and 3 (12,000).

Akuapem Poloo will only have to pay GH12,000 to get out of jail, according to the Court's decision. 
If she does not pay, she will be sentenced to 90 days of hard labor, according to the court. 

Charges 

Three counts of publication of obscene materials, engaging in domestic violence, conduct that in any way undermines another person's privacy or integrity, and engaging in domestic violence, namely conduct that detracts or is likely to detract from another person's dignity and worth as a human being were filed against the outspoken actress. 

Rosemond had previously pleaded not guilty to all charges after posting a naked photo of herself with her son on social media on June 30, 2020.
