COALITION FOR PUBLIC HEALTH AND JUSTICE SUE GOVERNMENT OVER VACCINE MANDATE

The Coalition for Public Health and Justice has filed a lawsuit against the government over the forced COVID-19 immunization and travel restrictions.

According to the Coalition, the President has not issued an Executive Order endorsing obligatory vaccination, hence the requirement is unconstitutional.

At the time of this litigation, checks at the Assembly Press revealed that the President of the Republic of Ghana had not issued any Executive Instrument restricting the right to free movement due to COVID-19 vaccine limitations. "Neither did the respondents' impugned directions make any reference to any such executive instrument," the suit read in parts.

Mandatory vaccination also violates several portions of the Public Health Act, according to the lawsuit.

"The respondents' impugned directives, which require the said COVID-19 vaccines for all persons, including those who have fully recovered from COVID-19 infections and have developed natural immunity to the disease, are unreasonable and violate Section 21(2) and 25 (1) (b) of the Public Health Act, 2012 (Act 851)."

In a letter to the president, the Coalition had previously urged the government to suspend the vaccination mandate across all public and private institutions in the country.

According to the writ, the Jubilee House and other governmental organizations and agencies have refused unvaccinated people access to their premises and amenities.

As a result, the Coalition is asking the court to declare the vaccination requirement a violation of Ghana's 1992 Constitution, Article 21 (1) (g).
