COURT STRIKES OUT ASSIN NORTH MP’S APPEAL CHALLENGING HIGH COURT’S DECISION

The appeal of beleaguered Assin North MP James Gyekye Quayson was dismissed by a Court of Appeal in Cape Coast due to non-compliance with court processes.

 

Mr. Quayson filed an appeal against a high court decision ordering fresh elections in his constituency and prohibiting him from running for office.

 

 

The presiding judge, Irene Charity Larbi, indicated in her ruling on Tuesday that the embattled MP failed to comply with the court's directions to submit his written answer within a certain time frame.

 

All applications before the panel in regard to the Assin North MP must also be dismissed, according to the ruling. The Assin North MP's case was adjourned by the Court of Appeal to March 22, 2022, after Counsel for the MP, Tsatsu Tsikata, sought clarification on why the court had decided to use C.I. 47 to deal with the pending application for stay of execution.

 

On January 24, 2022, the court's registrar issued Mr Gyaakye Quayson and his counsel a certificate of non-compliance.

 

Form 6, which is just a notice of shipment of records to the Court of Appeal, was sent to them in this regard.

 

 

This signifies that all of the high court's records pertaining to the original petition had been sent to the court of appeal. The MP had 21 days to file his written submission, but they failed to do so, and the court's registrar was forced to issue a certificate of non-compliance as a result.

 

Tsatsu Tsikata, the Assin North MP's lawyer, told the court that they had submitted three motions, one of which aimed to disqualify the presiding judge from sitting on the case, before the hearing began on Tuesday. However, the panel stated that such applications were not before them and that, as a result, they would proceed to deal with the issues at hand.

 

 

The judge denied the appeal in front of the panel and ordered the dismissal of all petitions related to the appeal case.

 

"You can't put something in a box," Lord Denning said, according to the judgment.
