SUPREME COURT THROWS OUT ASSIN NORTH MP’S APPLICATION

In a majority judgment, the Supreme Court dismissed an application brought by Assin North MP James Gyakye Quayson.

This was a petition to the Supreme Court asking it to overturn a March 8 judgement ordering the legislator to file his defense in a case trying to prevent him from executing his parliamentary duties.

 

 

On March 8, the Court stated that the MP had been sufficiently informed about the case against him.

 

 

On February 22, the Supreme Court ordered that court proceedings be made public by publishing them in the Daily Graphic newspaper and displaying them on the walls of the Supreme Court in Accra, the High Court in Cape Coast, and the MP's home.

This came after the private citizen who brought the lawsuit against the MP, Michael Ankomah Nimfah, told the court through his lawyers that all attempts to get court documents to the MP had failed.

 

The Assin North Parliamentary elections were declared invalid by a Cape Coast High Court in July 2021, after it was determined that Mr Quayson owed allegiance to a country other than Ghana at the time of filing his nomination paperwork to contest the polls.

 

Since then, the MP has been battling to get the ruling overturned in the Court of Appeal.

 

 

Mr Nimfah's lawyers want the MP barred from fulfilling Parliamentary duties while they await the Court of Appeal's ruling.

 

On March 8, the MP's lawyers, lead by Tsatsu Tsikata, told the court.
