The Supreme Court has barred James Gyakye Qyayson, the Member of Parliament (MP) for Assin North, from exercising his parliamentary responsibilities as of today, April 13, 2022.
Mr. Quayson's continued stay in office despite a High Court judgment annulling his election, according to Michael Ankomah Nimfah, a resident of the Assin North constituency, violated Ghana's 1992 Constitution.
According to him, the MP's actions were unjust to the people of Assin North and against Ghana's 1992 Constitution.
Mr. Quayson's plea to the SC comes after a Cape Coast High Court judgment in July 2021 annulled his election, finding that he owed loyalty to Canada when he submitted his candidacy to run for MP.
By restricting the MP, the plaintiff had requested the apex court to implement the Cape Coast High Court judgment and avoid a further infraction of the constitution.
The Attorney General, Godfred Yeboah, backed the plaintiff's case, believing that the legislator's continued presence in Parliament is a constitutional violation that must be allowed to fester.
"Because of the undisputed facts in this instance. It is evident that the court is confronted with a patent issue of unconstitutionality every day."
