A request for a subpoena to be issued for five witnesses sought by Dr Stephen Opuni, a former COCOBOD Chief Executive, has been granted by an Accra High Court.
The motions were allowed by Justice Honyenuga, a Supreme Court Justice with additional responsibilities as a High Court judge.
He stated that the Registrar of the Court, with the assistance of Mr Samuel Codjoe, Counsel for Dr Opuni, should carry out the order by giving the appropriate addresses for service on the individuals.
The court instructed the Registrar to carry out the order in collaboration with the first accused's counsel.
Dr. Opuni and Mr. Agongo are accused of defrauding the state through false pretenses and wilfully causing financial harm to the state.
Money laundering, corruption by a public official, and a violation of the Public Procurement Act are all charges that have been leveled against him.
They have both pled not guilty to the accusations and are free on self-recognizance bail of GH300,000.00 each.
The application's counsel had previously said that they wished to rely on Article 19(2)(g)(h) of the Constitution.
He said they asked the court to issue a subpoena for Reginald Aduakwa, a banker assigned to Dr Opuni at Ecobank, and Samuel Amponsah, the Acting Head of Cocoa Health and Extension Division, under Article 19(g) (CHED).
The next person they wanted the Court to subpoena was Peter Okyere Boateng, CHED's Deputy Executive Director in charge of Monitoring and Evaluation, according to the Counsel.
He stated that Mr. Boateng was in direct contact with him.
