The Supreme Court denied the motion for an injunction against the introduction of the Electronic Transactions Levy by a 7-0 vote (e-levy).
The Ghana Revenue Authority (GRA) has also been ordered by the Supreme Court to keep all data created after the tax was implemented on May 1, 2022.
Minority Leader Haruna Iddrisu responded to the verdict by saying he is happy with the Court's direction to the GRA till the substantive matter is resolved.
This section of the Supreme Court's verdict was regarded as "refreshing and heartening" by the Tamale South MP.
"At least some individuals will wait until the substantive situation is resolved before collateralizing it." "We brought this up because it is an issue of public interest and constitutional significance," he said.
"We are pleased with our lawyers' performance. We can only hope that Ghana will not have two sets of laws. One that supports and protects the government's elected elite, and the other that serves the opposition's political minority," he continued.
On the substantive issue before the court, Attorney-General (A-G) Godfred Yeboah Dame stated that 266 MPs were involved in the proceedings leading up to the E-approval. levy's
The bill's approval and subsequent passage into law, according to the A-G, is constitutional.
He claimed that on March 29, when the policy was passed, there were only 274 lawfully elected Parliamentarians, not 275, since the Assin North MP, James Gyakye Quayson, had not yet been elected.
The A-G said that this is due to a March 22 judgment by the Court of Appeals, which dismissed Mr. Quayson's appeal.
As a result, the AG stated that 137 people were necessary to conduct Parliamentary business on that particular day.
Except for Dome-Kwabenya MP Sarah Adwoa Sarfo, all 137 members of the Majority side were present, according to him.
The Minority Leader, on the other hand, is of a different mind.
It is unlawful, according to Haruna Iddrisu, to pass the bill into law with a vote count below the constitutional threshold of 138 MPs.
