What Are Principles Of Fiqh

By Imam Abi Abdullah ‘ Abdur-Rahman Ibn Nasir as Sa’di who died in 1956

1.All praise are due to Allah the Most High, the Most Kind. The brings things together and separates them

2.Of vast and abundant benefits, as well as the numerous and splendid wisdom

3.Then may the peace and blessings always be upon the last Prophet hailing from Quraysh.

 

As well as his family and noble companions, possessors of lofty status.

Know, may Allah guide you; that the best of favours is knowledge that removes doubt and sin.

And exposes the truth to the hearts; and leads the slave to his goal.

Safeguard your understanding of the rules/regulations that gather the questions/exceptions.

So progress in your knowledge and follow the path of those successful..

For indeed these are principles that I poemed.. gathered from the books of the people of knowledge.

May Allah reward them the grandest of rewards – and pardon with His forgiveness and goodness.

Intention is a condition for all actions- with it determines the validity and corruption of each act.

The religion is based on beneficial interests ( for the society) – which it establishes while repelling the evils.

If beneficial interests collide, the most profitable of them will be taken into account.

On the contrary, if the harms collide, the least harmful will be taken into account.

And from the principles of Shar’iah is case – in every matter which is difficult.

No one is obligated ( to act ) within the ability to do so- and there is no prohibition (sin) with dire necessity.

And every harmy(prohibition) that is done due to necessity- is according to the (minimum) need of the necessity.

And rulings are based on certainty- as certainty is not removed by doubt.

Concerning water, the principle is that it is pure, as well as the earth, clothing and stones.

Concerning intercourse and the types of (haram) meat and ( innocent) life and property of the protected

The principle is that it is forbidden ( haram) until there is proof for its allowance- may Allah guide you to understand this

Concerning the customs ( of the society) is that it is allowed- unless there is proof that says otherwise

And there is nothing legislated except which that is mentioned in our Shar’iah ( legislation)

And road that lead to an end (whether haram or halal) – then the ruling is applied to that as well

As for honest mistakes, being forced, or forgetting- then such is pardoned by the Most Merciful whom we worship.

However with it’s ( the act) spoiling the damage is affirmed- yet there is no sin or slippage on its doer.

And from the issues that cannot stand alone- then it shares the same ruling of what it follows

And the customs ( of people) is applied if there is present- a ruling from the noble Shariah that does not limit
