The bill of indictment against Oliver Mawuse Barker-Vormawor, one of the organizers of the #FixTheCountry campaign, has been drafted by the Office of the Attorney-General and Minister of Justice.
Mr Barker-Vormawor has been charged with two counts of treason felony, according to a copy of the bill obtained by the Daily Graphic.
The bill of indictment will allow the accused to be committed to the Ashaiman District Court on the accusations.
Committal
If the magistrate thinks the convener has a case to answer for his behavior at the committal stage, he will be committed to stand trial in the High Court on the charges recommended by the A-G.
Mr Barker-investigation Vormawor's cautioned statements, his charge sheet, charge statements, his Facebook and Twitter posts, intelligence reports from the Ghana Police Service's Cybercrime Unit, and intelligence reports from the National Security Ministry are some of the evidence the prosecution will rely on.
For the trial, the state expects to call three witnesses.
Summary of the Evidence
According to the bill of indictment's statement of evidence, on February 11, this year, the complainant noticed a post by the accused person that claimed, "If this E-levy passes after this cake crap, I will perform the coup myself." Army is a waste of time!"
On Tuesday, February 1, 2022, the case investigator who oversaw the Criminal Investigations Department's cybercrime team revealed that during his usual 24-hour cyber surveillance and social media monitoring, he picked up information on Oliver Barker-Facebook Vormawor's account that indicated "Year of Coups."
According to the summary, by Wednesday, March 9, 2022, the postings had 255 "likes" and 83 comments.
It went on to say that the investigator's examination of the "comments" section of the post from February 1, 2022, revealed that the accused had persuaded a number of individuals that it was necessary to take the Republic's executive powers through a violent overthrow of the Constitution.
According to the bill of indictment, this prompted the investigator to promptly inform his superiors of the intelligence he had obtained so that they could proceed with their plans.
The accused posted on his Facebook profile at 4:48 a.m. on Wednesday, December 23, 2022: "Democracy is yours! Nana Addo Dankwa Akufo Addo, your human rights activist President, is a liar! I'm waiting for my arrest, Ghana Police Service. The Republic of Nansins."
The accused is reported to have tagged the President of Ghana's and Ghana Police Service's official Facebook accounts. In another case, the accused is reported to have made the following statement: "This Attorney-General is unconcerned about God. He claims that the Chieftaincy Minister, who was sick and bedridden, went into the chambers and voted for the E-levy, despite the fact that we all saw him stuck in his ambulance. If the Supreme Court truly abandons its dignity to join the puppet master in that deception, all in the name of punishing Ghanaians with E-levy at all costs so that Article 71 holders can live large at the expense of the people, then we have crossed the Rubicon of No Return, and I will carry out the coup myself. Army is a useless force."
According to the bill of indictment, the post received over 400 responses, with 70% of his followers endorsing his plans to stage a revolution in Ghana.
Arrest
Mr. Barker-Vormawor was detained by the authorities in February of this year for "threatening to organize a coup."
The accused, via his attorneys, was granted bail in the sum of GH2 million with two sureties before the Tema High Court.
