COURT TOSSES OUT ATO ESSIEN'S APPLICATION FOR STAY ONCE MORE

An Accra High Court has excused William Ato Essien, organizer behind the old Capital Bank's application for stay of procedures, forthcoming the assurance of an allure against one of its decisions.

The Court managed by Justice Eric Kyei Baffour, a Judge of the Court of Appeal, sitting as an extra High Court Judge, held that the award of a stay was a discretional activity and that the candidate had not exhibited any uncommon situation.

Mr Essien, Rev. Fitsgerald Odonkor, the then Managing Director of the Bank and Tettey Nettey of MC Management Services, are being investigated for the GHS620million proposed to Capital Bank as liquidity support by the Bank of Ghana.

He said analyzing the idea of the application, the affidavit on the side of the application and the connection would leave any serious court with just a single decision that the application was only unimportant.

He said the shows conceded as proof didn't have anything in it that penetrated the denounced individual's privileges and that the case that the allure raised a serious questionable mark of regulation couldn't be right. "l excuses the application as it doesn't have merit," he said.

Mr Baffuor Gyau Bonsu Ashia, Counsel for Mr Essien, moving the application, said the movement was recorded on June 9, 2022, against the Court's own decision.

He said they had joined to the movement two shows, which were the decision of the Court and appended as stamped display B, the notification of allure.

The Counsel said the perusing of the notification of allure would demonstrate that they had raised serious legitimate issues not entirely settled by the Court of Appeal.

He said exceptional conditions being shown was the confirmation of the pen drive, which contained the review accounts of the showdown between the unique examinations group and the denounced individual.

Mr Ashia implored the Court to give them the stay of its own decision.

Mrs Marina Appiah-Opare, Chief State Attorney, said they were against the movement since they had not shown any uncommon conditions that would warrant a stay.

In the interim, the questioning of Rev. Odonkor proceeds. The case was dismissed to June 23, 2022.
