An Accra District Court is trying six people accused of involvement in the Van precious metals heist ordered that the file on the case must be forwarded to the Attorney General (AG) for advice.
This is to facilitate the process, otherwise the case would be struck out, Ms Patricia Amponsah, the judge said.
While adjourning the case, the court said the prosecution had failed to comply with court orders and since the AG was charged with the prosecution, she should be allowed to give her advice.
She therefore adjourned it to August 8, 2022, saying that if the AG relents, the accused persons will be released.
Deputy Superintendent of Police (DSP) Sylvester Asare earlier told the court that constables Yaro Afisu Ibrahim, Albert Fosu, Richard Boadu, Rabiu Jambedu and Nelson Tettey are recruited colleagues and friends while Zakaria is a car mechanic.
In 2021, police recorded a series of precious metal deliveries and street robberies in the Greater Accra region and deployed surveillance, prosecutors said.
On 22 February 2022, following a tip-off that armed men had attacked a precious metals van with registration number GN 424-14 in North Kaneshie, an investigation was launched which led to the arrest of Constable Reindolpho Gyimah Ansah alias Pablo and Lance Corporal Stephen Nyame [both deceased]. Further investigation led to the arrest of the accused persons.
He said the constables, including the deceased officers after their basic training, were posted to the National SWAT Unit, Police Headquarters, while Tettey was posted to the Rapid Deployment Force [RDF], Wa.
The court heard that Yaro, Fosu, Rabiu and Tettey, when posted to their respective units, underwent various tactical and specialized weapons training to equip them for the function of their units, which included escorting and protecting the Bullion Vans.
Further investigation revealed that in February 2022, the accused persons, including their deceased colleagues and persons at large, conspired, attacked and attempted to rob Mon-Tran Ghana's Bullion Van with registration number GN 424-14.
They shot at the bulletproof van with AK 47 rifles and used Royal motorbikes said to belong to Tettey, which were ridden by their accomplices at large. Boadu's duty was to track the van and feed the gang information.
