A Ugandan woman has found herself dealing with the constitution and has been ordered to pay and amount of $80,000 as damages to one Mr. Richard Tumwine after failing to fulfill her promise of getting married to him after he paid her tuition fees throughout the university.
A Ugandan woman identified as Fortunate Kyarikunda broke her pledge to marry Richard Tumwine, according to Magistrate Grade One Asanasio Mukobi of the Chief Magistrate's Court of Kanungu in Uganda.
According to reports published online by Nile post, the two met in 2015 when Richard Tumeine was a teacher at kiringa primary school and she Fortunate Kyatikunda went there for her teaching practice. The two began communicating frequently leading to them falling in love, which Richard offered to take the cost of Fortunate’s university cost which he faithfully fulfilled.
In 2022, Richard decided to hold a marriage ceremony and marry her lover Fortunate however she rejected, stating that the man was too old to be her husband.
Due to this sudden betrayal and heartbreak, Richard Tumwine filled a lawsuit against Fortunate Kyatikunda and requested for sh 9.4million ($80,000) in damages.
Upon further investigation as posted by Nile reports, the court found out that, the plaintiff had a legitimate point of filing for damages since the defendant could nit fulfill her part of the promise by getting married to the plaintiff.
Quoting the words of the magistrate, he revealed the following;
"Therefore, I hold that since the promise to marry was not fulfilled by the defendant to the injury of the plaintiff, then the plaintiff is entitled to reimbursement of his Sh9,439,100 spent on her."
To add to the damages that was requested by the plaintiff, the court also ordered the defendant to pay an additional amount of legal fees which was not stated.
