Tuesday, an application for a stay of proceedings will be heard by the Accra High Court as Dr Stephen Opuni, a former COCOBOD chief executive awaits the outcome of an interlocutory appeal.
The prosecution and counsel for Mr Seidu Adongo, a businessman and Agricult Ghana Limited (A2/A3), were to be served by 1:00 p.m. on January 30, 2023, per the court's order, which was given to the registrar.
The case has been postponed until January 31, 2023, Tuesday.
The move, which the court's registrar had previously scheduled for hearing on February 2, 2023, was made in opposition to the court's earlier decision to deny one of the accused person's petitions.
27 allegations, including defrauding by false pretences, willfully inflicting financial harm to the State, money laundering, and corruption by a public person in violation of the Public Procurement Act, are brought against Dr Opuni and Mr Agongo, a businessman.
They are each free on a self-recognizance bond of Ghanaian $300,000.00 after entering not-guilty pleas to the allegations.
Although she had seen a copy from the council, Mr Stella Ohene-Appiah, principal state attorney, earlier informed the court presided over by Justice Clemence Jackson Honyenuga that they had not been served by Dr Opuni's attorney.
She asked the court to extend the deadline for the continuation of the cross-examination of the seventh defence witness by counsel for Adongo and Agricult Ghana Limited to Monday, January 30, 2023.
The submission goes against the prosecution's own Supreme Court defence, as well.
He said that although the court might shorten the time, he was not prepared and ready to make his case in court since he had been led by the date specified by the court's registrar.
The attorney said that for the court to proceed without considering the application would be unlawful.
Agongo's attorney, Mr Nutifafa Nutsukpui, stated that they thought the second and third accused parties had a right to receive copies of the motion that had been submitted to the court.
He stated that before the application was heard, they prayed that they would have the chance to serve.
