OBRAFOUR SUES DRAKE $10MILLION FOR COPYRIGHT INFRINGEMENT

In today's music industry, sampling has become a common practice, with artists incorporating pieces of pre-existing songs into their own creations.


While this can add a unique flavor to a new track, it can also lead to legal disputes over copyright infringement. One such case involves the renowned Ghanaian rapper Obrafour and the Canadian superstar Drake. Obrafour, known as the "Rap Sofo" of Ghana, has recently filed a lawsuit against Drake, alleging that he sampled Obrafour's song "Oye Ohene (Remix)" without permission in his track "Calling My Name."




Sampling without proper licensing or permission has caused Obrafour to raise a legal action against the international star.


In this case, the fact that Drake's team had reportedly requested permission to sample the song, but was declined, makes the situation even more complicated. It remains unclear why Drake proceeded to use the sample in his song without permission.





Obrafour's lawsuit seeks $10 million in compensation, citing the success of the song and the alleged infringement of his copyright.


This situation raises questions about the ethics of sampling and copyright laws in the music industry. It also highlights the importance of obtaining proper permission and licenses before using someone else's work. 


“Obrafour sues for copyright infringement under the Copyright Act, and seeks all remedies afforded to him thereunder, including preliminary and permanent injunctive relief, monetary damages, including but not limited to, actual damages, profits directly and indirectly attributable to from Defendants’ infringing conduct, statutory damages under the Copyright Act in the sum of up to $150,000.00 per infringement where such infringement commenced after the Copyrighted Work was registered with the United States Copyright Office, and other economic relief,” part of the suit reads.




It remains to be seen how this dispute will be resolved, but it serves as a reminder to all artists to be mindful of the legal and ethical implications of using others' work in their own creations.
