The Presidential Court is hearing the case of Atiku against Tinubu,
The first hearing of the petitionfiled in the petition court forthe 2023 presidential electioncontinues today.
Reports earlier said that the first trial started on Monday, with two political parties (Action Alliance (AA) and All Peoples Party (APP) withdrawing their complaintsagainst President-elect Bola Tinubu at the Independent National Electoral Commission (INEC) ). The five-member panel presided over by Justice Haruna Tsammani will also hear the petition filed by the People'sDemocratic Party (PDP) presidential candidate Atiku Abubakar and his party.
At about 8:35 in the morning,Atiku arrived at the court to see the progress of the case he filed to challenge his appearance inthe 2023 presidential election. The former vice president ofthe PDP is arguing that Tinubu declared the ruling All Progressives Congress (APC) party as the winner of the presidential election.
Atiku is asking, among other things, to withdraw the return certificate issued by INEC to Tinubu. At 10:30 am, the presidential court dismissed Atiku's case against Tinubu, APC and INEC.
The court adjourned the case to May 18. The court also heard a plea on the life insurance of the system on Thursday, and the respondents said they would file their response on Monday.
Justice Tsammani commended the parties for their cooperation and agreement, saying that thiswould contribute to the speedyconclusion of the pre-trialsession. Meanwhile, the Court of Appeal for the Presidential Election at the Court of Appeal in Abuja will hear a petition by the Allied Peoples Movement (APM) challenging the victory of the president-elect.
At Tuesday's hearing, the parties advised the court that they had filed a pre-hearing letter TF 008 and accepted the answers contained therein. However, the president-elect asked the court to dismiss the appeal filed by PAM.
Tinubu's lawyer, Akin Olujimi, told the court that their response to the prayer was to strike out the petition on the grounds of frivolous allegations.
