Court orders clerk to impound controversial car

The High Court of Accra has ordered the Registrar of the Court, the Constitutional Court, to impound the car amid controversy in the case in which Deborah Seyram Adablah sued a banker, Ernest Nimako, for threatening sex.

The former national employee through his petition says among other things the vehicle registered GC 7899-21l, ownedby Mr. He was bought byNimako, the first defendant in the case. In court on TuesdayMay 16, the court (General Court) presided over by Justice Olivia Obeng Owusu, while ruling on Mr Nimako's petition,said the vehicle in questionshould be handed over to the secretary of Supreme Court to keep it. until the final decisionof the case. 

To achieve this, the court also ordered Mr. Nimako, the defendant (the plaintiff) to hand over all the documents related to the vessel to the Registrar. He claims that Mr.Nimako registered the car thathe bought from him in his name and contrary to their agreement, seized the 120 GH¢Honda Civic. 

EIB Network Legal Affairs Correspondent Murtala Inusahwho was in court said that the claimant (Adablah) brought thevehicle to court. But, he will deliver it to the clerk of the court today, as ordered by the court.

Justice Obeng Owusu also ordered the plaintiff (Adablah) and the 1st defendant (Ernest Nimako) to stop posting it on social media. This is how Mr. Nimako, through his lawyers,filed a petition asking the court to stop Adablah from posting the messages he continued on TikTok, Instagram and other social media platforms. 

But in his affidavit against this allegation, Adablah, through hislawyers denied this allegationand said that these announcements were madebefore any legal action was taken. Ruling on the petition,the court said both parties were prohibited from publishing prejudicial documents until the final decision. 

"Both
 parties are prohibited from sharing videos, images and materials on social media and traditional media that oftenprejudice the court until the final decision of the case," the court ordered. Background 

Adablah,
 who is the plaintiff,filed a complaint for sexual harassment against Ernest Kwesi Nimako, a bank manager. 

After
 the incident, the bank asked to be removed from the lawsuit brought by the former NSS employee. In the petitiondated January 24 this year, the bank requested that seven paragraphs of the petition be dismissed "because they do not reveal any reasonable grounds to take action against the plaintiff."

He argued
 that paragraphs 7, 8, 9, 10, 11, 31, 32, 33, 34, 36 and 37 which were sought to be removed included the text which accused the bank of monitoring children. female workers and the elderly aresexually threatened. . A seriouscase alleging sexual harassment will be processed after this preliminary application is completed. 

Adablah
 sued Mr Nimako in January 2023, accusing him of breach of contract to buy her a car, pay her rent for three years, pay her GH¢3,000 monthly,marry her after divorcing his wife and giving her away. he raised money to start a business. He claims that Mr Nimako registered the car he bought for him in his name and contrary to their agreement, hetook back the GH¢120,000 Honda Civic after he used it for just one year.

He said that the accused was his boss in the bank and paid him
 only one year's rent againsttheir agreement. Ms. Adablah accused Mr. Nimako of abuse, harassment, bullying, harassment and defamation ofher reputation in the public eye.

He asked
 the court to compel Mr. Nimako to fulfill his promise.
