The court later acquitted therape survivor of manslaughter

A rape survivor who was sentenced to six years and two months for aggravated assaultin connection with the murderof a man who raped her has been acquitted by the High Court.

A person who robs
a woman by force will be in prison. A personwho robs people by force will be in prison.
In
the first decision to jail her, the court agreed that Roxana Ruiz, 23, a Mexican citizen, acted in self-defense, but added that she went too far.

According to the court, it is understandable that he killed someone by force in 2021 in self-defense, but the force he put into self-defense was too much, so the death of the victim strength in strength.

The court convicted the rape victim of murder and "in extreme self-defence". In his opinion, hitting the rapist'shead was sufficient for the assault, and Ruiz could not add anything else, which caused the death of his assailant.

It was reported that he first hitthe victim unconsciously, then strangled him and then tried to mutilate his body. He kept the body for at least 20 hours before placing it in a plastic bag on the street.

Ruiz, defending what he did, told the court, "It's my life or his life. All I want is to protect my life from a violent person.

Along with
the prison sentence,Ruiz, who is from the southern state of Oaxaca, was also ordered to pay more than US$16,000 in restitution to the family of the rapist.

The single mother had already spent nine months in pre-trial detention before being released for the remainder of her sentence. In sentencing her, the court said it considered that Ruiz had "weakness as a woman and as a citizen".

In May 2021, Ruiz was selling fries in Nezahualcoyotl, one of the eleven cities in the state ofMexico with an ongoing sexual orientation for women and another for forcing women to disappear. While drinking beer with a friend, Ruiz, a Mixtecwoman and single mother from the state of Oaxaca, met a man she saw in the neighborhood. After he finished, he promisedto take her home, and told herto stay the night because it was late and he was not at home. Ruiz agreed to sleep on a mattress on the floor. But while she was sleeping, he climbed into her bed, punched her, tore her clothes and raped her, according to Carrera, Ruiz'slegal guardian. Ruiz retaliated, punched her in the nose, and threatened to kill her. In an attempt to free himself, hekilled her in self-defense,Carrera said. Panic-stricken,Ruiz put the man's body in a bag and dragged him off the roadwhere he was apprehended by a passing police officer.
