NPP's Gary Nimako sues Ga East Assembly, MCE for GH?130,000 in unpaid legal fees

A private lawyer in
the New Patriotic Party (NPP) Chief Legal Officer Gary Nimako Marfo has filed a lawsuit against the Ga East Municipal Assembly and its Mayor, Elizabeth Kaki Mann, for non-payment of GH?130,000 in unpaid legal fees.

Marfo, represented by his law firm Marfo and Associates, according to a report from Asaaseradio.com, submitted a statement to the High Court seeking four remedies in the case. Marfo is first seeking to collect unpaid legal fees of GH?130,000. In addition, it asks the court to grant interest on the money at commercial rates, from November 2021 until the final payment. It also seeks damages for breach of contract and compensation, including legal fees.

In support of his statement,Gary Nimako Marfo says, “Under the said detainer, thelegal charges are filed against each individual, and from the house his legal services, he offered legal services to the first defendant. the start of the contract until October 2021."

He went on to explain that when Elizabeth Kaki Mann took over as head of state in September 2021, she decided to end their engagement. Marfo says he returned all documents and records of the Ga East Municipal Assembly to the defendants in accordance withthe settlement agreement.

The complaint further states: “The plaintiff asserts that whenthe records were disclosed to the defendants, the new counsel for the defendants,Kingsley Amoakwa-Boadu Esq., called the plaintiff to obtain his consent to proceed with the business, which was duly granted."

Regarding the unpaid bills,Marfo says, “The plaintiff alleged that he then issued an invoice for one hundred and thirty fifty Ghana cedis(GH?130,050.00) to the defendants as deposit and payment of disputes until the termination date according to the document. Agreement."

Despite sending the defendants a letter of demand in November 2021, demanding payment of the debt, Marfo alleged that the city manager Elizabeth Kaki Mann refused or did not honor the debt. He quotes, "The 2nd charge especially insists that he will not pay the plaintiffbecause the contract with the Assembly was registered and through his means."

Marfo went on to point out that he sent a written letter of intentto sue the defendants in August 2022, which was ignored. He explains that all efforts made by some Ga East Municipal Assembly accountants to getthe mayor to pay the debt failed. Gary Nimako Marfo concluded that unless the Court intervenes and compels the Ga East Municipal Assembly and its executive to fulfill their financial obligations, the unpaid legal bills will remain unpaid.
