Justice Gertrude Araba Esaaba Sackey Torkornoo has been overwhelmingly elected as Ghana's 15th Chief Justice (CJ).


After Theodora Woode and Sophia Akuffo, Justice Torkornoo is now the third woman to hold one of the country's most important positions, thanks to the MPs' resounding support for her yesterday.



Motion

The Chief Justice demonstrated character, competence, and dexterity in her understanding of the law during her vetting just a few weeks ago, according to Joe Osei Owusu, the Chairman of the Appointments Committee of Parliament, who made the motion for the nominee's confirmation.


The committee's chairperson, who also serves as First Deputy Speaker of Parliament, quoted from the study and stated that, if appointed Chief Justice, she would promise to interpret the law impartially.


The committee urges the House to endorse its recommendation and unanimously elect Justice Gertrude Araba Esaaba Sackey Torkornoo as Chief Justice of the Republic of Ghana, he added.



The Minority Chief Whip, Kwame Agbodza, seconded the motion but voiced reservations about the incoming Chief Justice's perspective on citizenship.


He stated that it was concerning because she insisted throughout the screening that a birth certificate was not evidence of citizenship.


Mr. Agbodza said that she must act to change her position because it may result in a miscarriage of justice for a lot of Ghanaians.



Former Minority Leader Haruna Iddrisu argued in favour of the motion because the Supreme Court was not there to criticise the House.


He said that under the 1992 Constitution's protections for free speech, people had the right to object to court rulings that they found to be unsatisfactory from a legal and likely factual perspective.


In civilised nations, including Ghana, according to Mr. Iddrisu, the MP for Tamale South, the Supreme Court judges are the Legislature's employees.


They are to interpret the laws that we create.



Because of this, it is important that we avoid using unclear language while interpreting the law. We must direct the Supreme Court, he declared.


He also discussed James Gyakye Quayson's decision, highlighting the possibility that the Supreme Court miscalculated while dispensing justice.


He asked the newly appointed Chief Justice to enhance the E-Justice programme she has long advocated.


Evidence of citizenship is a constitutional issue that may be resolved under Article 6 of the Constitution, according to Samuel Atta Akyea, the MP for Abuakwa South.



He stated that one may go to court if they discover something improper with that.


"The nominee is a symbol of the power of womanhood," he said.


According to Mr. Atta Akyea, women's intelligence matters more than only their physical appearance.


He said, "I'm convinced she will transform the judiciary's look.


What a woman can do, a man cannot, and what a man can do, a woman can, according to Techiman North MP Elizabeth Ofosu Agyare.
