LAWYER PROTESTS AGAINST CONSTITUTIONAL REVIEW, CALLING FOR DISCIPLINE AND A CHANGE IN ATTITUDE

David Ofosu-Dorte, a renowned attorney, has spoken out against the 1992 Constitution's review.

Even if the Constitution had certain flaws, he claimed that it was still quite effective and wasn't to blame for the country's many problems.


Instead, he claimed, the Constitution's users and operators, especially those in positions of authority, had discovered a way to ignore its principles in order to further their personal interests, a development he claimed had been detrimental to the nation.

Therefore, the attorney said, a thorough review of the Constitution will be pointless absent a shift in the culture and thinking of the populace.


Speaking at the 2023 Constitutional Day Public Lecture was Mr. Ofosu-Dorte, Chairman of the pan-African law firm AB & David Africa. The event was sponsored by the University of Professional Studies, Accra (UPSA) Law School and a pressure group called OneGhana Movement.

He claimed that the nation's culture was one of deifying individuals in positions of power without doing enough to hold them accountable.

Because of this, he claimed, no matter how many times the Constitution is reviewed, those in power will always find a way to get around it, adding that "no rule, including the Constitution, is good enough to stop evil-minded individuals from doing what is wrong."


Additionally, there are no laws that are so horrible that they could stop a good person from doing morally. No matter how good the legislation is, you will exploit it if you mean to, according to Mr. Ofosu-Dorte.

He referenced the number of ministers appointed by the President as an illustration of how politicians have misused the Constitution.

Although just 19 Cabinet Ministers were specified in Article 76(1) of the Constitution, according to him, more than 19 ministers were selected who weren't designated as cabinet ministers.



"The politicians have come up with a wonderful technique to differentiate between cabinet ministers and other ministries. The Constitution won't stop us if we have the desire to act improperly, the attorney claimed.
