The High Court in Accra ordered Anas Aremeyaw Anas to testify in open court in the trial of the former president of the Ghana Football Association, Kwesi Nyantakyi, on Wednesday, May 17, 2023.
However, Anas was permitted to present a different identity during his evidence by the court, which was presided over by Justice Marie Louise Simmons.
Again, in accordance with the court's decision, Mr. Nyantakyi will get a chance to view Anas' face in chambers.
Justice Simmons made the decision in response to the prosecution's request for Anas to testify behind closed doors.
Mr. Nyantakyi's attorneys opposed the application and asked the judge to allow Anas to testify in open court while having his face visible rather than grant his request.
In her decision, Justice Simmons partially allowed the application and ruled that Anas was free to testify in public while wearing his bead mask because he had previously been observed doing so.
Tiger Eye P.I., the private investigation company that Anas is the head of, has released a statement outlining the risks involved with disclosing his identity to Kwesi Nyantakyi.
As much as Anas is eager and prepared to provide testimony for the defense, doing so in accordance with the requirements stated due to the problems detailed above creates a clear and present risk to his security and safety, according to the court.
Considering the situation, he should deny the request to jeopardize his life and, in turn, decline the invitation to expose his identity to the defendant in the courtroom or any other location.
Tiger Eye supports Anas' stance and asserts that it is right and prudent to err on the side of caution in order to prevent any potential assault on one of its investigators.
